Corruption: Policeman's acquittal affirmed by Court of Appeal
Judges of the Court of Appeal headed by Tan Sri Md Raus Sharif and Datuk Sulong and Datuk Mohamed Matjeraie Apandi Ali, unanimously dismissed the appeal of the prosecution against the decision of the High Court to overturn decision of the Court of Sessions 'to discharge and acquit Corporal Busra SEBL.
On October 2007, Busra was sentenced in Sessions Court to accept cash from RM100 Roslan Adenan parking at the Central Police Station at 5:45 p.m. July 13, 2005.
He was found guilty under section 11 (a) of the Anti-Corruption Act 1997 and sentenced to one year imprisonment and a fine of RM10, 000 in default six months imprisonment.
Busra appeal to the High Court, where Judge Datuk Linton Albert HC set aside the decision and his sentence was overturned.
The appellant, who was represented by a lawyer Lim Lian Kee, had accepted money to take no action against the complainant for an offense under the Road Transport Act to modify the bike.
Earlier in his submission, Lim told the court that the plaintiff admitted in his testimony that he noted the name of the accused on a piece of paper, but it was never submitted to the court.
The complainant also claimed that passes the name of the accused to an officer of the Agency and Anti-Corruption Commission (now known as the Malaysian Anti Corruption Commission), but the officer denied the have received, Lim told the three judges.
Lim said the benefit of the doubt should be given to the caller.
Busra, which was attached to the duty of police to beat Central Mobile has been banned since his case was mentioned in court Dec. 19, 2006.
Meanwhile, the High Court upheld the conviction of his female colleague Busra, Corporal Abang Mohd Basri Dayang Huzaimiah to give statements contrary to the MACC police officer and judge of the Court of Sessions.
Huzaimiah 3 Sessions Court had here in August 2007, appeared before a judge to testify as a key witness in the case of Busra.Huzaimah was charged under section 19 (2) of the Anti-Corruption Act 1997 and sentenced to 15 months imprisonment and a fine of RM5, 000 in default six months imprisonment.
